Supermax prisons are often described as "high_tech." Observers seem to mean two things by this. The first is that these "prisons within prisons" are a technology in themselves: hard_edged and brightly lit, the fortress_like supermax clearly signals its specialized purpose of isolation and control. The second is that supermax prisons rely heavily on specialized, relatively new technologies: computerized systems produce new forms of intensive surveillance while special teams armed with electronic shields maintain control over prisoners.But as Leo Marx observed several (...) years ago in this journal, "technology is a hazardous concept" . We need to see the technology of the supermax prison in these terms if we are to understand its effects. My aim here is to consider three aspects of the technology of supermax. The first is the sense in which the supermax prison is itself a "machine" _ a specific invention with a purpose and meaning closely linked to its features as a technology. This aspect is important for understanding what makes the construction of these prisons so attractive to correctional professionals and so seemingly acceptable to the general public. The second aspect is the use of specialized tools of control inside the supermax prison. These internal solutions to problems of order _ I will discuss computerized surveillance, special response teams, and stun technology _ offer clues to how specific technologies intersect with intensive confinement to frame punishment as decisive "action" produced by prisoners' "choices" and analogous to "war." Finally, supermax technology imposes specific practices and ways of being on both prisoners and prison staff. These need to be understood not only for how they augment and intensify other negative aspects of these environments, but also for their potential to affect prisoners in quite different ways depending on individual vulnerabilities.A common theme running through my discussion of each of these aspects of supermax is that the appearance of specialized technology constitutes what Garland describes, for penal practices in general, as a "signifying practice" . Beyond its immediate effects during use, supermax technology offers the cultural gloss of a "high_tech solution" that helps to frame problems _ some of them caused by supermax confinement in the first place _ largely in terms of their susceptibility to technical intervention. In other contexts "technology" signifies a "clean," profitable, scientific, and masculine approach: direct action on manageable problems. The spillover of this imagery into prisons _ in association with other meanings of crime and punishment _ is one element serving to obscure the larger issues posed by mass incarceration. As Marx points out, the reification of technology has the effect of producing an aura of inevitability. I will return to this point at the end to consider briefly how a framing of supermax primarily in terms of technology can itself be seen as hazardous. (shrink)

The sex‐determining genes of fungi reside at one or two specialised regions of the chromosome known as the mating type (MAT) loci. The genes are sufficient to determine haploid cell identity, enable compatible mating partners to attract each other, and prepare cells for sexual reproduction after fertilisation. How conserved are these genes in different fungal groups? New work1 seeks an answer to this question by identifying the sex‐determining regions of an early diverged fungus. These regions bear remarkable similarity to those (...) described in other fungi, but the sex proteins they encode belong to only a single class of transcription factor, the high mobility group (HMG), indicating that these are likely to be ancestral to other proteins recruited for fungal sex. Although fair trade has grown exponentially in the U.S. in recent years, we do not have a clear understanding of why small U.S. firms choose to participate in it. To answer this question, we use a qualitative case study approach and grounded theory analysis to explore the motivations of 35 small fair trade businesses. We find that shared values and the desire to help others, often triggered by a critical incident, lead social entrepreneurs to found and sustain fair trade businesses. (...) The relationship between shared values and engagement in fair trade and the relationship between altruism and engagement in fair trade are strengthened by four motivating factors: direct relationships with producers, support for social causes, the desire for the preservation of craftsmanship, and the desire to share aesthetic products. These links are strengthened by four facilitating factors : the acquisition of business knowledge, family member involvement in the firm, assistance from faith communities, and assistance from the fair trade community. Additional analysis reveals three types of fair trade social entrepreneurs: “ethics first” entrepreneurs, primarily motivated by human rights and social justice concerns; “faith first” fair traders, motivated primarily by their religious faith; and “business first” businesspeople, motivated by what they perceive to be an opportunity to build a successful business while simultaneously doing “good” and helping others. We whole-heartedly support Andrew Garland, Stephanie Morain, and Jeremy Sugarman’s claim that clinicians have a duty to participate in pragmatic clinical trials (Garland, Morain, and Sugarman 2023)...

In this case report, we describe a woman with advancing dementia who still retained decisional capacity and was able to clearly articulate her request for deactivation of her implanted cardiac pacemaker—a scenario that would result in her death. In this case, the patient had the autonomy to make her decision, but clinicians at an outside hospital refused to deactivate her pacemaker even though they were in unanimous agreement that the patient had capacity to make this decision, citing personal discomfort and (...) a belief that her decision seemed out of proportion to her suffering. We evaluated her at our hospital, found her to have decision-making capacity, and deactivated her pacer resulting in her death about 9 days later. While some clinicians may be comfortable discussing patient preferences for device deactivation in patients who are imminently dying, we can find no reports in the literature of requests for device deactivation from patients with terminal diagnoses who are not imminently dying. The following article is a response to the position paper of the Hastings Center, “Ethical Challenges of Chronic Illness”, a product of their three year project on Ethics and Chronic Care. The authors of this paper, three prominent bioethicists, Daniel Callahan, Arthur Caplan, and Bruce Jennings, argue that there should be a different ethic for acute and chronic care. In pressing this distinction they provide philosophical grounds for limiting medical care for the elderly and chronically ill. We give a critical (...) survey of their position and reject it as well as any attempt to characterize the physician-patient relationship as a commercial contract. We emphasize, as central features of good medical practice, a commitment to be the patient's agent and a determination to acquire and be guided by knowledge. These commitments may sometimes conflict with efforts to have the physician serve as an instrument of social and economic policies limiting medical care. (shrink)

ABSTRACT While interest in philosophy and medicine has burgeoned in the past two decades, there remains a need for an analysis of the intellectual activity embodied in good medical practice. In this setting, ethical and scientific decision‐making are complexly interrelated. The following paper, collaboratively written by physicians and philosophers, presents a view of applied (clinical) science and applied ethics. Making extensive use of illustrations drawn from routine case material, we seek to indicate a variety of philosophic issues to be found (...) in daily practice, elucidate various levels of critical reasoning within the medical setting, and demonstrate a remarkable similarity between medical and ethical decision‐making. In modern industrial society the issue of access to healthcare is inseparable from the question of whether there is a right to healthcare and whether government has the correlative duty to assure a minimum level of care to all citizens. While discussion in terms of rights and duties tends to direct our attention to broader, more theoretical ethical issues, discussion in terms of invites consideration of more practical concerns. The news media rarely report in terms of whether a citizen's right (...) to healthcare has been abridged or disregarded, but rather offers tales of people being denied access. Advocacy groups for specific illnesses do not necessarily argue for universal health insurance, but rather press that certain conditions, such as renal failure requiring dialysis, receive unlimited insurance coverage and that people with the condition be given automatic access to care. It is widely assumed that there exist certain objects which can in no way be distinguished from each other, unless by their location in space or other reference-system. Some of these are, in a broad sense, 'empirical objects', such as electrons. Their case would seem to be similar to that of certain mathematical 'objects', such as the minimum set of manifolds defining the dimensionality of an R -space. It is therefore at first sight surprising that there exists no branch of (...) mathematics, in which a third parity-relation, besides equality and inequality, is admitted; for this would seem to furnish an appropriate model for application to such instances as these. I hope, in this work, to show that such a mathematics in feasible, and could have useful applications if only in a limited field. The concept of what I here call 'indistinguishability' is not unknown in logic, albeit much neglected. It is mentioned, for example, by F. P. Ramsey [1] who criticizes Whitehead and Russell [2] for defining 'identity' in such a way as to make indistinguishables identical. But, so far as I can discover, no one has made any systematic attempt to open up the territory which lies behind these ideas. What we find, on doing so, is a body of mathematics, offering only a limited prospect of practical usefulness, but which on the theoretical side presents a strong challenge to conventional ideas. Facial appearance changes with age and health affecting skin color as well as facial and head hair. Yet somehow the brain is able to see past shared structure and dynamic deformations to focus on subtle details that distinguish one face from another. This article argues that the brain takes an efficient approach to this problem using prior knowledge about the structure of faces in its analysis. It employs intrinsic norms to focus on subtle variations in the shared face configuration that (...) differentiate one face from another. The study reviews evidence that the brain uses multiple norms to extract face identity that these norms are shaped by visual experience, and that norm-based coding is well-suited to meeting the challenges of image-based face perception mentioned above. By encoding faces with reference to stored perceptual norms the visual system can focus on what is unique to each individual, allowing for the discrimination of thousands of faces despite their similarity. The use of virtual humans holds the potential for interactive, automated interaction in domains such as remote communication, customer service, or public announcements. For signed language users, signing avatars could potentially provide accessible content by sharing information in the signer's preferred or native language. As the development of signing avatars has gained traction in recent years, researchers have come up with many different methods of creating signing avatars. The resulting avatars vary widely in their appearance, the naturalness of their movements, (...) and facial expressions—all of which may potentially impact users' acceptance of the avatars. We designed a study to test the effects of these intrinsic properties of different signing avatars while also examining the extent to which people's own language experiences change their responses to signing avatars. We created video stimuli showing individual signs produced by a live human signer, an avatar made using computer-synthesized animation, and an avatar made using high-fidelity motion capture. We surveyed 191 American Sign Language users, including Deaf, Hard-of-Hearing, and Hearing groups. Participants rated the three signers on multiple dimensions, which were then combined to form ratings of Attitudes, Impressions, Comprehension, and Naturalness. Analyses demonstrated that the Mocap avatar was rated significantly more positively than the CS avatar on all primary variables. Correlations revealed that signers who acquire sign language later in life are more accepting of and likely to have positive impressions of signing avatars. Finally, those who learned ASL earlier were more likely to give lower, more negative ratings to the CS avatar, but we did not see this association for the Mocap avatar or the Human signer. Together, these findings suggest that movement quality and appearance significantly impact users' ratings of signing avatars and show that signed language users with earlier age of ASL acquisition are the most sensitive to movement quality issues seen in computer-generated avatars. We suggest that future efforts to develop signing avatars consider retaining the fluid movement qualities integral to signed languages. (shrink)

This paper attempts to get some critical distance on the increasingly fashionable issue of realism in political theory. Realism has an ambiguous status: it is sometimes presented as a radical challenge to the _status quo_; but it also often appears as a conservative force, aimed at clipping the wings of more ‘idealistic’ political theorists. I suggest that what we might call ‘actually existing realism’ is indeed a conservative presence in political philosophy, and that its ambiguous status plays a part in (...) making it so. But I also argue that there is no necessary connection between realism and conservatism. This paper describes the three contingent and suspiciously quick steps which lead from an initial commitment to being attentive to the real world, via a particular kind of pessimism about political possibilities, to an unnecessarily conservative destination. In the process, I try to show how the ubiquitous trinity of realism, pessimism and conservatism might be pulled apart, thus removing the artificial tension between ‘being realistic’ and the demand for far-reaching social change. Part I provides a summary statement of the interpretive approach, and Part II develops the theme of blurring genres and discusses a variety of (...) research methods common in the humanities, including: ethnographic fieldwork, life history, and focus groups. Part III demonstrates how the genres of thought and presentation found in the humanities can be used in political science. It presents four examples of such blurring 'at work' with studies of: applied anthropology and civil service reform; women's studies and government departments; and storytelling and local knowledge. The book concludes with a summary of what is edifying about an interpretive approach, and why this approach matters, and revisits some of the more common criticisms before indulging in plausible conjectures about the future of interpretivism. ABSTRACT As owner of the New Lanark cotton-mills from 1800, Robert Owen carried out a social experiment designed to transform the lives of his community of millworkers, through improved living and working conditions, free medical care and education. He intended to demonstrate how his ideas, if universally adopted, could transform society in general. Central to this experiment was his innovative and enlightened system of education in the Institute for the Formation of Character. This article looks in particular at the musical (...) life of New Lanark and explores Owen’s belief in the power of music to bind together people from different backgrounds, and to assist in the creation of a harmonious community. Lavishly funded musical activities played a major part in the curriculum, and in the life of the community as a whole. All this is well documented and fascinating insights into the lives of the New Lanark people are included in the travel journals and letters, some previously unpublished, of the many visitors who came to see Owen’s model community. Foucault’s critique of early modern political theory aimed at displacing sovereignty as the principle of intelligibility of power. In the genealogical literature since Foucault, sovereignty has become a residual category lacking analytic specificity, largely displaced by governance, in turn equated with politics. We argue that Foucault and the Foucauldians have not understood that the flourishing of governance has presupposed a symbolic regime with a division of knowledge-power-law characteristic of the democratic sovereign. The conflation of governance with politics, together with the (...) sliding of sovereignty under governance, has left Foucauldians unable to diagnose the dangers present in varying possible sovereignty-governance configurations. Protection against bacterial and viral pathogens by antibodies has always been thought to end at the cell surface. Once inside the cell, a pathogen was understood to be safe from humoral immunity. However, it has now been found that antibodies can routinely enter cells attached to viral particles and mediate an intracellular immune response. Antibody‐coated virions are detected inside the cell by means of an intracellular antibody receptor, TRIM21, which directs their degradation by recruitment of the ubiquitin‐proteasome system. In this (...) article we assess how this discovery alters our view of the way in which antibodies neutralise viral infection. We also consider the antiviral function of TRIM21 in the context of its other reported roles in immune signalling and autoimmunity. Finally, we discuss the conceptual implications of intracellular antibody immunity and how it alters our view of the discrete separation of extracellular and intracellular environments. (shrink)

Alison Jaggar recommends a radical break with a dominant approach to the philosophy of immigration shared by both liberal cosmopolitans and liberal nationalists. This paper is intended as an exploration of Jaggar’s conclusions and as an attempt to carry them further. Building on her critique, I argue that the characteristic questions asked by both cosmopolitans and nationalists appear inappropriate when seen against the political reality of immigration. In the last part of the paper, I argue that liberal nationalist contributions in (...) particular have problematized immigration and immigrants in ways not fundamentally different from those seen on the racist right. Roberto Esposito has extended the deconstructive theory of the gift into political philosophy, theorizing the gift as the transcendental form of political obligation. In Esposito's philosophy of communitas, the munus consists of the single obligation to give, a logic of donors without receivers, yet it simultaneously establishes relations of reciprocity, mutuality, debt and gratitude. I argue that that indebtedness and reciprocity are not logically possible in a gift system where donors are bound by the single obligation to give, as the (...) donor has no other and the gift no recipient. These inconsistencies may be addressed by distinguishing two forms of gift in communitas: the impersonal gift characterized solely by the obligation to give to the gods/communitas and the reciprocal gift characterized by the obligations to give, receive and return the gift. Esposito's philosophy of communitas would additionally be strengthened by conceptualizing symbolic practices, specifically collective representations, as intrinsic to the munus. As impersonal gift, the munus is a symbolic practice through which the members of communitas represent to themselves their being-in-common. The munus operates as a vertical relation of expenditure made possible by the collective representation of the political we. The reciprocal gift, in contrast, constitutes differentiated social ties and networks: the being-in-difference of communal life. The distinction between the impersonal and the reciprocal gift gives rise to a minimal division between the political and the communal within the transcendental structure of communitas. (shrink)

Since its influential rendering by Rae Langton in her 1993 paper, “Speech Acts and Unspeakable Acts,” the “silencing argument” against pornography has become the subject of a lively debate that continues to this day. My intention in this paper is not to join in the existing debate, but to give a critical overview of it. In its current form, I suggest, it is going nowhere . Yet the silencing argument, I believe, nevertheless contains an indispensable insight—and more radical potential than (...) is usually acknowledged either by its defenders or its opponents. I argue that in order to preserve this insight and unleash its potential, we should begin by adopting the following motto: MacKinnon, not Austin! (shrink)

Recent political developments have made the notion of 'post-truth' ubiquitous. Along with associated terms such as 'fake news' and 'alternative facts', it appears with regularity in coverage of and commentary on Donald Trump, the Brexit vote, and the role – relative to these phenomena – of a half-despised, half-feared creature known as 'the public'. It has become commonplace to assert that we now inhabit, or are entering, a post-truth world. In this paper, I issue a sceptical challenge against the distinctiveness (...) and utility of the notion of post-truth. I argue, first, that the term fails to capture anything that is both real and novel. Moreover, post-truth discourse often has a not-fully-explicit political force and function: to ‘irrationalise’ political disaffection and to signal loyalty to a ‘pre-post-truth’ political status quo. The central insight of the speech act theory of J. L. Austin and others – that saying is always also doing – is as indispensable for understanding the significance of much of what is labelled ‘post-truth’, I’ll argue, as it is for understanding the significance of that very act of labelling. This article considers the challenge posed by Gayatri Spivak to rethink world literature along postcolonial lines as an ethical encounter with alterity. Read in this way, Spivak participates in a reframing of world literature that retains the critical gains made by postcolonial theory and suggests that the work of world literary analysis ought not necessarily be de/prescriptive but might involve a contestation of the power relations that structure the world. In developing this argument, I draw on four further perspectives: Pascale (...) Casanova's problematic assertion of literary singularity in The World Republic of Letters; Fredric Jameson's theorization of “third world literature” as counterpoint to Casanova's limiting understanding of national literature; Gilles Deleuze, who offers a way to rethink world literature in a process of becoming; and Édouard Glissant, whose work proposes a “relational” vision of difference that, like that of Spivak, demands an ethical, imaginati.. Critical responses to Wide Sargasso Sea have seized upon Rhys's novel as an exemplary model of writing back. Looking beyond the actual repetitions which recall Brontë’s text, I explore Rhys's novel as an expression of virtual difference and becomings that exemplify Deleuze's three syntheses of time. Elaborating the processes of becoming that Deleuze's third synthesis depicts, Antoinette's fate emerges not as a violence against an original identity. Rather, what the reader witnesses is a series of becomings or masks, some of (...) which are validated, some of which are not, and it is in the rejection of certain masks, forcing Antoinette to become-Bertha, that the greatest violence lies. Nous chercherons ici à montrer comment le projet Tela Botanica permet à la fois une transformation et une actualisation du savoir botanique. Trois éléments particuliers retiendront notre attention : la libre circulation et la mise à disposition des données les plus récentes du travail des botanistes ; l’articulation nouvelle entre le travail scientifique des amateurs et celui des professionnels ; la création d’une forme organisationnelle hybride combinant des éléments propres au milieu associatif et à l’entreprise privée. We discuss three characteristics in particular: the ready availability and free circulation of the most up-to-date botanical data, new links between the scientific work of amateur and professional botanists and the appearance of a hybrid organisational form that combines features from the non-profit model and from private enterprise. Alexithymia is a dimensional trait characterized by difficulties identifying and describing feelings and an externally oriented thinking (EOT) style. Here, we explored interrelationships between alexithymia and measures assessing how individuals process and regulate their responses to environmental and body-based cues. Young adults (N= 201) completed self-report questionnaires assessing alexithymia, sensory processing sensitivity (SPS), interoceptive accuracy (IA), sensory processing styles, and current levels of depression, anxiety, and stress. Whereas EOT was related to low orienting sensitivity, problems with emotional appraisal (difficulties identifying (...) feelings/difficulties describing feelings) were related to heightened sensory sensitivity. In addition, features of SPS improved the prediction of alexithymia above and beyond that accounted for by IA. We suggest that EOT is linked to problems maintaining a representation of one’s emotions in working memory and that low IA and problems with emotional appraisal are linked to atypicalities in sensory processing that may impact embodiment. A latent profile analysis revealed five classes of individuals distinguished by the relative strength of different alexithymic traits and by differences in IA and sensory processing styles. The classes identified included two lexithymic, one modal, and two alexithymic groups, showing different susceptibilities to SPS. Overall, our findings lend support to the view that alexithymia is associated with atypicalities in both bottom–up and top–down processes that impact emotion processing and regulation. They also raise the possibility that individuals with different alexithymia subtypes may differ with regard to a range of factors, including not only SPS but also early life experiences, mental health outcomes, and susceptibility to various personality disorders. In recent years, scholars have identified a political formation that mobilizes the emancipatory energies of feminism in the service of the expansion of the carceral state. ‘Carceral feminism,’ as it has come to be known, is often portrayed by these scholars as a product of feminist-conservative convergence. Here, I argue that the rise of the SlutWalk movement suggests a more complex genealogy for carceral feminism. By situating SlutWalk in the historico-theoretical context of feminism’s sex wars, I reveal the carceral–feminist impulses (...) roiling beneath its progressive ‘sex-positive’ surface. With its tendency to reduce sexual freedom to expressive freedom, valorize conventional forms of femininity and sexuality, and promote a fundamentally carceral paradigm of sexual freedom, the SlutWalk movement, I argue, is descended from anti-censorship/pro-sex feminism, a liberal-feminist hybrid that emerged out of the convergence of sex-radical feminism and liberalism during the sex wars. When viewed in this light, SlutWalk no longer appears as a sign that feminism’s ‘pleasure’ and ‘danger’ factions have negotiated a long-awaited ‘sex-détente.’ Rather, it stands as a testament to the extent to which feminism’s once radical aspirations in the domain of sexual politics have been supplanted by a tepid, heteronormative, and disquietingly carceral liberal project. Because the process of moving from moral principles and facts to action-guiding moral conclusions has not been articulated clearly enough to be useful in a practical way, we designed a systematic approach to aid learners and clinicians in their application of ethical principles to the resolution of clinical dilemmas. Our model for clinical moral reasoning is intended to provide a clear and replicable structure that makes the thought process involved in reasoning about clinical cases explicit.
